Miguna Miguna be Advocate for High Court of Kenya. E dey practice law as attorney, barrister plus solicitor for Toronto, Canada. Miguna serve as senior adviser to former Kenyan Prime Minister Raila Amollo Odinga from 2009 go 2011.[1][2]

E get Bachelor of Arts for political science plus philosophy from University of Toronto for 1990. After dat, e go study law for Osgoode Hall Law School of York University for Toronto, wey e get ein Juris Doctor degree for 1993. E enter Ontario Bar for 1995. E come later get Masters of Laws (LLM) from Osgoode Hall Law School of York University for 2001.

Miguna serve as Coordinator for Committee for Democracy in Kenya (CDK) from 1988 reach 1994.[3]

Insyd March 2009, dem appoint am as Prime Minister Raila Odinga ein senior adviser on coalition affairs, den e serve too as Joint-secretary to de Permanent Committee on de Management of de Grand Coalition Affairs plus Kivutha Kibwana. Insyd August 2011, dem accuse am say e misconduct grossly, so dem suspend am without pay. Dem lift de suspension for 29 December 2011, but Miguna reject ein reinstatement.[6][7]

Insyd 2010, some people from de Party of National Unity side inside de coalition accuse am say e be foreigner sake of say e dey hold Canadian passport. At dat time, de Kenyan law no dey recognise dual citizenship, even though dem change de constitution for 2010 to allow am. Dem write say, "Even though Mr. Miguna Miguna born for Kenya, e later become Canadian citizen. Like all other expatriates wey dey work for de country, our laws dey require say Mr. Miguna apply make e get de right permits to live den work for Kenya." Miguna reply say e be Kenyan citizen by birth and say e never renounce ein citizenship. But e still acquire Canadian citizenship at some point wen e dey exile. Miguna explain say, "Wen you dey run from dictatorship, you go use any means. Even Mr. Odinga sef use Tanzanian passport one time."[8][9]

Insyd September 2012, e resign ein life membership from ODM den announce say e go contest for Governor of Nairobi County inside de 2013 gubernatorial election as independent candidate. But later e cancel de candidacy. Insyd February 2013, e launch de sequel to ein memoir; de title be Kidneys for the King: Deforming the Status Quo in Kenya.

As way to show say he reject ein former political boss, Miguna support Uhuru Kenyatta—wey be Odinga ein rival—for de 2013 presidential election. Kenyatta end up win de election, even though Odinga talk say de election no clean plus say dem do poll fraud.

Insyd March 2016, Miguna announce say he go contest for Nairobi Governor position as independent candidate. Insyd August 2016, he unveil ein manifesto. De manifesto promise visionary leadership based on integrity, clear den progressive transformative policies, programs, den commitment to service delivery, job creation den infrastructure development. Even though he come fourth for de 2017 Nairobi gubernatorial elections wey happen for 8 August 2017, Miguna no gree say he lose.

Insyd August 2017 presidential election, Odinga plus ein supporters talk say de victory wey Uhuru Kenyatta win be fraud. De Supreme Court of Kenya cancel de declaration say Uhuru Kenyatta plus William Ruto be validly elected president and Deputy President, respectively. De Court talk say de Independent Electoral and Boundaries Commission (IEBC) commit plenty illegalities and irregularities, den dem no do de 8 August 2017 presidential election according to de Constitution of Kenya, 2010 plus other proper laws. De Supreme Court order say dem for do de election again insyd sixty days. But de Court sana order say make de IEBC open demma servers plus KIEMS kits make dem do forensic audit before de repeat election. De High Court of Kenya rule say de election no follow proper procedure, so another election happen for October. Mr. Odinga no join dat election, say e no go be fair plus credible.

Dem declare Kenyatta as de winner plus 98% of de vote.

But after de 2017 presidential election, Miguna turn ein stance round completely—e become one of de loudest supporters of Odinga, den one of de hardest critics of Kenyatta ein government. E accuse de Kenyatta administration say dem be despotic den say dem rig demselves into power.

Miguna be de leader of de National Resistance Movement, wey be opposition group wey dey do civil disobedience activities to support Odinga. But on 30 January 2018, de Kenyan government declare say de National Resistance Movement be organised crime group.

On 30 January 2018, for one mock swearing-in ceremony, Miguna na de one wey give oath of office to Raila Odinga, wey talk say e be “de people ein president”. De government vex then shut down all de TV and radio stations. Dem arrest Miguna plus anoda lawyer, T J Kajwang’, wey witness de ceremony (but dem no arrest Odinga, sake of say dat one fit cause more wahala from ein supporters). Dem carry Miguna go court, charge am say e dey present den e gree make dem give oath wey be capital offence—wey be treason. High Court talk make dem release am on bail den make dem open de TV stations back, but de government no hear. Chief Justice David Maraga bash de officials wey no obey court, e talk say “Disobeying court orders dey against de rule of law.” Dem seize Miguna ein Kenyan passport den force am commot for de country. Interior Cabinet Secretary Fred Matiang’i talk say de passport wey dem seize so, dem issue am in fraud way. Government talk say Miguna no talk about ein Canadian citizenship when e apply for Kenyan passport in 2009, so de application no valid. Miguna fight back say, “De constitution clear pass anything: nobody fit cancel citizenship of person wey dem born as Kenyan.” De government still maintain say de National Resistance Movement be organised crime group.

On 26 March 2018, Miguna try return back to Kenya. E land for Jomo Kenyatta International Airport for Nairobi from Dubai. As e reach, e demand make dem allow am enter based on many valid court orders, but Immigration officials no gree. Dem talk say make e enter as tourist or visitor, but Miguna no accept dat. Same day, state security agents try deport am back to Canada through KLM flight wey dey go Amsterdam, but Miguna resist am loud loud. Immigration officials come detain am for de airport. De whole scene enter internet through video footage wey go viral. Dem hold am for airport for 2–3 days before dem forcefully return am back to Dubai. Miguna smuggle ein Canadian passport commot from de airport to stop dem from deport am, so e present only ein Kenyan national ID card to enter de country. Immigration no accept am, say dat one no be correct document to enter Kenya from Dubai. Miguna talk say e no wan show Canadian passport because, “I arrived in Kenya on March 26 as a Kenyan born citizen.” One of ein lawyers talk for affidavit say government seize Miguna ein Canadian passport, but later both Miguna and Kenyan authorities deny dat. When dem send Miguna back to Dubai, e manage go Canada from there—most likely with de same Canadian passport. As dem dey detain am, court give many orders make dem release am den no remove am from de court ein jurisdiction. But government no obey. Justice George Odunga of de High Court for Nairobi come convict Interior Minister Fred Matiang’i, Principal Secretary for Immigration Gordon Kihalangwa, Inspector General of Police Boinett, den CID boss George Kinoti for contempt of court. Dem fine all of dem. Still, government refuse obey de court and insist say Miguna must fill forms to “regularise” ein Kenyan citizenship.

On 28 March 2018, Human Rights Watch release one statement wey call for Miguna ein release. Otsieno Namwaya from Human Rights Watch talk say, “Kenyan authorities suppose urgently obey de many court orders to either release or produce Miguna for court. To hold am for airport without any kind of judicial review, plus violation of court orders, na clear example of arbitrary detention.”

Still on 28 March, just few hours before dem deport Miguna again, High Court judge George Odunga declare say de Interior Minister, de National Police Chief, den de Head of Immigration all dey guilty of contempt of court because dem no obey de order wey talk say make dem release Miguna. Di judge come fine each of dem US$2000 (UK£1,400).

Miguna talk say dem physically assault am, torture am, den forcefully drug am plus intravenous sedative before dem carry am put for inside plane go back Dubai. Ein talk say he no even dey conscious during di journey. Miguna release one photo of ein hand injury wey he say na from de injection of di sedative. Some journalists wey dey cover di story too talk say government officials assault dem. Insyd ein Facebook post, Miguna write say, "Dem drag me, assault me, drug me den forcefully fly me go Dubai," den he add say, "I dey sick. My ribs den body dey pain me everywhere. Dis be real travesty of justice."

On 29 March, Irungu Houghton, wey be de Executive Director of Amnesty International for Kenya, release statement wey call on authorities make dem allow Miguna enter de country so he go fit take part for de court proceedings. He talk say, “Di way wey dem take treat Miguna show clear disregard for ein human rights, after High Court already order say make dem allow am re-enter de country. Kenyan government too must respect plus protect de right to freedom of expression, and make dem allow journalists report de case freely without harassment, intimidation or attack.”

Amnesty talk say, “De continuous disregard for court orders plus attacks on de media dey steadily spoil de rule of law and dey weaken human rights protection for de country.” Dem come request make government “launch proper, independent den neutral investigation into how police dey unlawfully use force take stop journalists from doing demma work.”On 12 April 2018, former Kenyan Chief Justice Dr. Willy Mutunga, for interview inside John Githongo ein platform, condemn how dem treat Miguna, call am inhumane plus unconstitutional. Dem quote am say, “E be nauseating. E dey very painful.”

Then on 14 December 2018, de High Court of Kenya give one landmark judgment. Inside dat ruling, de court sharply condemn de state say dem seriously violate Miguna ein constitutional den fundamental rights—especially ein birthright citizenship wey dem talk say he no fit lose and wey de state no fit cancel. De court rule say Miguna be full Kenyan citizen and he get right to valid Kenyan passport. Dem order make de state give am new correct passport. De court come hold say de destruction of Miguna ein house, ein arrest, detaining am without contact, den how dem forcefully carry am comot from Kenya all be illegal plus inhumane. Dem talk say de whole treatment be physical, emotional den psychological torture. Justice Enoch Chacha Mwita award Dr. Miguna Miguna seven million Kenyan shillings (Sh7 million) for damages for how dem violate ein rights, plus Kshs. 270,000 as special damages for how de state destroy ein house for Runda. De court order say make de state officers wey Miguna sue pay de damages from demma own pocket.

Insyd December 2019, Miguna Miguna announce publicly for ein Twitter say he dey plan return to Kenya, and dis go be ein third attempt. He talk say he dey rely on court order wey dem issue for December 2018 wey allow am come back. He announce say ein flight go land for Jomo Kenyatta International Airport for Nairobi on de morning of 11 January 2020. But ein return no happen again as both Lufthansa den Air France airlines deny am chance to enter demma flights. Dem talk say de Kenyan government issue "red alerts" against ein planned trip, so dem no go fit carry am.

Then on 6 January 2020, Kenyan High Court Judge, Justice Weldon Korir, order say make de government help Miguna enter back into de country. He add say make de registrar release Miguna ein Kenyan passport wey still dey under demma custody.

Make dem issue order now and e go still dey valid after dem hear both sides for court. Dis order dey compel de Respondents make dem allow de Petitioner enter Kenya on January 7, 2020 or any other day wey de Petitioner go choose. Dem go take de Petitioner ein National Identity Card or ein Kenyan Passport—just as de Respondents take deliver am to de High Court Registry—as valid identification for dis entry, based on de earlier order from dis same Court. — 

Kenyan Justice John Mativo summon de Kenyan Attorney General, Mr Paul Kihara Kariuki, make he appear for court on 13 January 2020 to explain why dem no obey de orders wey talk say make dem allow lawyer Miguna Miguna return to Kenya. But de Attorney General no show up for court. Instead, he send team of lawyers go represent am. Dis action vex Miguna Miguna ein lawyers, wey talk say de state dey treat de matter like joke.
